Is or Was Student in Legal Guardianship?

Previous

This is question 55 on the FAFSA.

For this question, the definition of legal guardianship does not include the student’s parents, even if they were appointed by a court to be the student’s guardian. The student is also not considered a legal guardian of himself / herself.

Yes means the student can provide a copy of a court’s decision that as of today the student is an emancipated minor or are in legal guardianship. Yes can also mean that the student can provide a copy of a court’s decision that the student was an emancipated minor or was in a legal guardianship immediately before they reached the age of being an adult in the student’s state. The court must be located in the student’s state of legal residence at the time the court's decision was issued.

No means the student is still a minor and the court decision is no longer in effect or the court decision was not in effect at the time the student became an adult.
